The flood of claims expected due to the blackout will seek to establish possible liability on the part of the State.

Experts believe it will be difficult to establish responsibility, but they are aware that the government could approve aid programs for affected businesses and individuals.

The recent nationwide power outage is expected to generate a flood of claims from individuals and businesses in the coming days seeking compensation for the damages caused. Some will seek to hold the state liable for the incident. The success of this initiative will depend on whether or not there was force majeure, or if the cause and origin of the blackout are definitively linked to negligence or a technical error within the electricity grid operator, Red Eléctrica.

This morning, the operator ruled out a cyberattack as the cause of the massive blackout, but the National Court has decided to open an investigation to determine if a cyberattack occurred. The other information blackout is that of the government, which has not clarified the situation and is contributing to a climate of unease among those affected by this disaster.

In any case, according to José María Torres, president of CONPYMES, an organization representing two million self-employed workers and SMEs nationwide, an initial assessment indicates that losses in the retail sector could amount to billions of euros.

Experts consulted by Economist & Jurist indicate that insurance companies will play a significant role in the days following the paralysis caused by the nationwide blackout.

Home insurance policies typically cover damage to electrical appliances, which could have occurred this Monday, or food spoilage in the refrigerator due to the power outage. It is also possible that the government will offer some form of assistance, without assuming full state liability, as requested by CONPYMES. "The coming days will be crucial in clarifying the situation, and depending on who is responsible, claims may be filed," they state.
